The purpose of this essay is to advocate for including jurilinguistics in legal education. It presents jurilinguistics as a tool for understanding law and therefore supports continuing efforts to teach it. Knowing it is not unique, this essay proposes a jurilinguistic approach that focuses on the in-between of legal translation and comparative law. The proposal outlines the importance of educating in the capabilities of teaching a particular subject in a language other than their official one. The idea is to let (...) the Other help to understand the Self. Particularly pertinent in transnational law programs, it is a multicultural approach that not only recognizes the other, but also embraces it. (shrink)

In this paper, we review and connect the three essential conditions needed by the collapse model to achieve a complete and exact formulation, namely the theoretical, the experimental, and the ontological ones. These features correspond to the three parts of the paper. In any empirical science, the first two features are obviously connected but, as is well known, among the different formulations and interpretations of non-relativistic quantum mechanics, only collapse models, as the paper well illustrates with a richness of details, (...) have experimental consequences. Finally, we show that a clarification of the ontological intimations of collapse models is needed for at least three reasons: (1) to respond to the indispensable task of answering the question ’what are collapse models (and in general any physical theory) about?’; (2) to achieve a deeper understanding of their different formulations; (3) to enlarge the panorama of possible readings of a theory, which historically has often played a fundamental heuristic role. Mauro Dorato charts pressing debates within the philosophy of science that centre around scientific expertise, access to knowledge, consensus, debate, and decision-making. This English-language translation of Disinformazione Scientifica e Democrazia argues that the advancement of science depends on an exponential process of specialization, accompanied by the creation of technical languages that are less and less accessible to the general public. Dorato reveals how such a process must align with representative forms of democracies, in which knowledge and decision-making ought (...) to aim at the society's general interest. Given the importance of the principle of competence, however, the role of experts as mediators of knowledge threatens the citizens' autonomy of choice. Consequently, the risk of technocratic regimes calls for new ways to increase literacy about science and its philosophical and probabilistic foundations. In this paper we argue that the different positions taken by Dyson and Feynman on Feynman diagrams’ representational role depend on different styles of scientific thinking. We begin by criticizing the idea that Feynman Diagrams can be considered to be pictures or depictions of actual physical processes. We then show that the best interpretation of the role they play in quantum field theory and quantum electrodynamics is captured by Hughes' Denotation, Deduction and Interpretation theory of models (DDI), where “models” are (...) to be interpreted as inferential, non-representational devices constructed in given social contexts by the community of physicists. This paper offers a critical assessment of the current state of the debate about the identity and individuality of material objects. Its main aim, in particular, is to show that, in a sense to be carefully specified, the opposition between the Leibnizian ‘reductionist’ tradition, based on discernibility, and the sort of ‘primitivism’ that denies that facts of identity and individuality must be analysable has become outdated. In particular, it is argued that—contrary to a widespread consensus—‘naturalised’ metaphysics supports both the acceptability (...) of non-qualitatively grounded (both ‘contextual’ and intrinsic) identity and a pluralistic approach to individuality and individuation. A case study is offered that focuses on non-relativistic quantum mechanics, in the context of which primitivism about identity and individuality, rather than being regarded as unscientific, is on the contrary suggested to be preferable to the complicated forms of reductionism that have recently been proposed. More generally, by assuming a plausible form of anti-reductionism about scientific theories and domains, it is claimed that science can be regarded as compatible with, or even as suggesting, the existence of a series of equally plausible grades of individuality. The kind of individuality that prevails in a certain context and at a given level can be ascertained only on the basis of the specific scientific theory at hand. (shrink)

By briefly reviewing three well-known scientific revolutions in fundamental physics (the discovery of inertia, of special relativity and of general relativity), I claim that problems that were supposed to be crying for a dynamical explanation in the old paradigm ended up receiving a structural explanation in the new one. This claim is meant to give more substance to Kuhn’s view that revolutions are accompanied by a shift in what needs to be explained, while suggesting at the same time the existence (...) of a pattern that is common to all of the discussed case-studies. This paper deals with one of the first attempts to measure simple reactions in humans. The Swiss astronomer Adolph Hirsch investigated personal differences in the speed of sensory transmission in order to achieve accuracy in astronomy. His controversial results, however, started an intense debate among both physiologists and astronomers who disagreed on the nature of these differences. Were they due to different eyes or brains, or to differences in skill and education? Furthermore, they debated how to eliminate them. Some, for (...) example, wanted to eliminate the observer, and prescribed the use of new technologies like the electro-chronograph or photography, while others believed in discipline and education. By debating the nature of these differences, astronomers and physiologists sketched both different conceptions of ‘man’ and different paths to objectivity. These diverse conceptions, moreover, were tied to current nineteenth-century debates, such as the benefits or disadvantages of railroads, telegraphy and the standardization of time and longitudes. By focusing on the debates surrounding the speed of sensory transmission, this paper reevaluates the history of astronomy, physiology and experimental psychology. Debates about the ontological implications of the general theory of relativity have long oscillated between spacetime substantivalism and relationism. I evaluate such debates by claiming that we need a third option, which I refer to as “structural spacetime realism.” Such a tertium quid sides with the relationists in defending the relational nature of the spacetime structure, but joins the substantivalists in arguing that spacetime exists, at least in part, independently of particular physical objects and events, the degree of “independence” being (...) given by the extent to which geometrical laws exist “over and above” physical events exemplifying them. By showing that structural spacetime realism is the natural outcome of a semantic, model-theoretic approach to the nature of scientific theories, I conclude by arguing that the notion of partial isomorphic representation is the most plausible candidate to connect spacetime models with reality. The main claim that I want to defend in this paper is that the there are logical equivalences between eternalism and perdurantism on the one hand and presentism and endurantism on the other. By “logical equivalence” I mean that one position is entailed and entails the other. As a consequence of this equivalence, it becomes important to inquire into the question whether the dispute between endurantists and perdurantists is authentic, given that Savitt (2006) Dolev (2006) and Dorato (2006) have (...) cast doubts on the fact that the debate between presentism and eternalism is about “what there is”. In this respect, I will conclude that also the debate about persistence in time has no ontological consequences, in the sense that there is no real ontological disagreement between the two allegedly opposite positions: as in the case of the presentism/eternalism debate, one can be both a perdurantist and an endurantist, depending on which linguistic framework is preferred. The main claim of the paper is that one can be ‘realist’ (in some sense) about quantum mechanics without requiring any form of realism about the wave function. We begin by discussing various forms of realism about the wave function, namely Albert’s configuration-space realism, Dürr Zanghi and Goldstein’s nomological realism about Ψ, Esfeld’s dispositional reading of Ψ Pusey Barrett and Rudolph’s realism about the quantum state. By discussing the articulation of these four positions, and their interrelation, we conclude that instrumentalism (...) about Ψ is by itself not sufficient to choose one over the other interpretations of quantum mechanics, thereby confirming in a different way the indetermination of the metaphysical interpretations of quantum mechanics. -/- Key words: . Presentists have typically argued that the Block View is incapable of explaining our experience of time. In this paper I argue that the phenomenology of our experience of time is, on the contrary, against presentism. My argument is based on a dilemma: presentists must either assume that the metaphysical present has no temporal extension, or that it is temporally extended. The former horn leads to phenomenological problems. The latter renders presentism metaphysically incoherent, unless one posits a discrete present that, however, (...) suffers from the same difficulties that the instantaneous present is prone to. After introducing the main phenomenological models of our experience of time that are discussed in the literature, I show that none of them favors presentism. I conclude by arguing that if even the phenomenology of time sides against presentism, the latter metaphysical theory has no scientific evidence in its favor and ought to be dropped. (shrink)

In this paper I argue that the debate between the so-called “presentists” – according to whom only the present is real – and the “eternalists”, according to whom past present and future are equally real, has no ontological significance. In particular, once we carefully distinguish between a tensed and a tenseless sense of existence, it is difficult to find a single ontological claim on which the two parties could disagree. Since the choice of using a tense or a tenseless language (...) is dictated by purely pragmatic reasons, we should abstain from bringing to bear pseudo-debates generated by the “tensed” or the “tenseless theories” of time on the question of understanding the philosophical implications of contemporary spacetime theories, or notions like becoming, change and persistence in time. In this paper we argue that structural explanations are an effective way of explaining well known relativistic phenomena like length contraction and time dilation, and then try to understand how this can be possible by looking at the literature on scientific models. In particular, we ask whether and how a model like that provided by Minkowski spacetime can be said to represent the physical world, in such a way that it can successfully explain physical phenomena structurally. We conclude by claiming (...) that a partial isomorphic approach to scientific representation can supply an answer only if supplemented by a robust injection of pragmatic factors. (shrink)

In this paper I examine the role of dispositional properties in the most frequently discussed interpretations of non-relativistic quantum mechanics. After offering some motivation for this project, I briefly characterize the distinction between non-dispositional and dispositional properties in the context of quantum mechanics by suggesting a necessary condition for dispositionality – namely contextuality – and, consequently, a sufficient condition for non-dispositionality, namely non-contextuality. Having made sure that the distinction is conceptually sound, I then analyze the plausibility of the widespread, monistic (...) ontological thesis about the reducibility of dispositional properties to categorical properties in the context of the philosophy of quantum mechanics. I conclude that with the exception of Bohmian mechanics, the other “minimally realist” views of quantum mechanics require essential dispositions, i.e., dispositions of a non-reducible kind. Interestingly, seen behind the lenses of dispositionalism, Bohr’s and Bohm’s interpretations of quantum mechanics are much closer than it is usually recognized, a fact that could teach us something about the way the quantum world is. The paper compares dispositionalism about laws of nature with primitivism. It argues that while the distinction between these two positions can be drawn in a clear-cut manner in classical mechanics, it is less clear in quantum mechanics, due to quantum non-locality. Nonetheless, the paper points out advantages for dispositionalism in comparison to primitivism also in the area of quantum mechanics, and of contemporary physics in general.

Scientists hoped that the machine would fulfill a desire that had driven research for nearly half a century: that of capturing the world in its own image. But their elation was surprisingly short-lived, and many researchers quickly distanced themselves from the new medium. The cinematographic camera was soon split into two machines, one for recording and one for projecting, enabling it to further escape from the laboratory. (...) The philosopher Henri Bergson joined scientists, such as Etienne-Jules Marey, who found problems with the new cinematographic order. Those who had worked to make the dream come true found that their efforts had been subverted. This essay focuses on the desire to build a cinematographic camera, with the purpose of elucidating how dreams and reality mix in the development of science and technology. It is about desired machines and their often unexpected results. The interplay between what “is” (the technical), what “ought” (the ethical), and what “could” be (the fantastical) drives scientific research. (shrink)

We discuss the three dominant models of the phenomenological literature pertaining to temporal consciousness, namely the cinematic, the retentional, and the extensional model. This is first done by presenting the distinction between acts and contents of consciousness and the assumptions underlying the different models concerning both the extendedness and duration of these two components. Secondly, we elaborate on the consequences related to whether a perspective of direct or indirect realism about temporal perceptions is assumed. Finally, we review some relevant findings (...) from the psychology and neuroscience of temporality in order to decide which of the three models of time consciousness is better confirmed from an empirical viewpoint. Depending on the time scale, all three models of temporal consciousness might apply. We specifically argue in favor of an extensional model of time consciousness for the experienced present where the acts and contents of consciousness are both extended. The retentional model might apply to longer time intervals covered by working memory. In addition, a predictive component is highlighted as decisive for an understanding of temporality. (shrink)

In the first part of the paper I argue that an ontology of events is precise, flexible and general enough so as to cover the three main alternative formulations of quantum mechanics as well as theories advocating an antirealistic view of the wave function. Since these formulations advocate a primitive ontology of entities living in four-dimensional spacetime, they are good candidates to connect that quantum image with the manifest image of the world. However, to the extent that some form of (...) realism about the wave function is also necessary, one needs to endorse also the idea that the wave function refers to some kind of power. In the second part, I discuss some difficulties raised by the recent proposal that in Bohmian mechanics this power is holistically possessed by all the particles in the universe. (shrink)

An influential position in the philosophy of biology claims that there are no biological laws, since any apparently biological generalization is either too accidental, fact-like or contingent to be named a law, or is simply reducible to physical laws that regulate electrical and chemical interactions taking place between merely physical systems. In the following I will stress a neglected aspect of the debate that emerges directly from the growing importance of mathematical models of biological phenomena. My main aim is to (...) defend, as well as reinforce, the view that there are indeed laws also in biology, and that their difference in stability, contingency or resilience with respect to physical laws is one of degrees, and not of kind . In this paper, we evaluate some proposals that have been put forward to clarify the ontological consequences of relational quantum mechanics. We first focus on priority monism and ontic structural realism and argue that these views are not suitable for providing an ontological interpretation of the theory. Then, we discuss an alternative interpretation that we regard as more promising, based on so-called ‘metaphysical coherentism’, which we also connect to the idea of an event-based, or ‘flash’, ontology.

After some suggestions about how to clarify the confused metaphysical distinctions between dispositional and non-dispositional or categorical properties, I review some of the main interpretations of QM in order to show that – with the relevant exception of Bohm’s minimalist interpretation – quantum ontology is irreducibly dispositional. Such an irreducible character of dispositions must be explained differently in different interpretations, but the reducibility of the contextual properties in the case of Bohmian mechanics is guaranteed by the fact that the positions (...) of particles play the role of the categorical basis, a role that in other interpretations cannot be filled by anything else. In Bohr’s and Everett-type interpretations, dispositionalism is instrumentalism in disguise. (shrink)

In this paper I present and defend Rovelli's relation quantum mechanics from some foreseeable objections, so as to clarify its philosophical implications vis a vis rival interpretations. In particular I will ask whether RQM presupposes a hidden recourse to both a duality of evolutions and of ontology. I then concentrate on the pluralistic, antimonistic metaphysical consequences of the theory, due to the impossibility of assigning a state to the quantum universe. Finally, in the last section I note interesting consequences of (...) RQM with respect to the possibility of defining a local, quantum relativistic becoming.Given the difficulties of having the cosmic form of becoming that would be appropriate for priority monism, RQM seems to present an important advantage with respect to monistic views, at least insofar as far as the possibility of explaining our experience of time is concerned. The literature on the compatibility between the time of our experience--characterized by passage or becoming--and time as is represented within spacetime theories has been affected by a persistent failure to get a clear grasp of the notion of becoming, both in its relation to an ontology of events tt"spreadtt" in a four-dimensional manifold, and in relation to temporally asymmetric physical processes.In the first part of my paper I try to remedy this situation by offering what I consider a clear and (...) faithful explication of becoming, valid independently of the particular spacetime setting in which we operate. Along the way, I will show why the metaphysical debate between the so-called tt"presentiststt" and tt"eternaliststt" is completely irrelevant to the question of becoming, as the debate itself is generated by a failure to distinguish between a tensed and a tenseless sense of tt"existencett". After a much needed distinction between absolute and relational becoming, I then show in what sense classical spacetime physics presupposes both types of becoming, for the simple reason that spacetime physics presupposes an ontology of events. As a consequence, not only does it turn out that using physics to try to provide empirical evidence for the existence of becoming amounts to putting the cart before the horses, but also that the order imposed by tt"the arrow of becomingtt" is more fundamental than any other physical arrow of time, despite the fact that becoming cannot be used to explain why entropy grows, or retarded electromagnetic radiation prevails versus advanced radiation. In the literature on the compatibility between the time of our experience and the time of physics, the special theory of relativity has enjoyed central stage. By bringing into the discussion the general theory of relativity, I suggest a new analysis of the misunderstood notion of becoming, developed from hints in Gödel's published and unpublished arguments for the ideality of time. I claim that recent endorsements of such arguments, based on Gödel's own ‘rotating’ solution to Einstein's field equation, fail: once (...) understood in the right way, becoming can be shown to be both mind-independent and compatible with spacetime physics. Being a neededtertium quidbetween views of time traditionally regarded as in conflict, such a new approach to becoming should also help to dissolve a crucial aspect of the century-old debate between the so-called A and B theories of time. In a reply to Nicholas Maxwell, Stein has proved that Minkowski spacetime can leave room for the kind of indeterminateness required both by certain interpretations of quantum mechanics and by objective becoming. By examining the consequences of outcome dependence in Bell-type experiments for the co-determinateness of spacelike-related events, I argue that the only becoming relation that is compatible with both causal and noncausal readings of the quantum correlations is the universal relation. This result might also undermine interpretations of quantum mechanics (...) requiring non-epistemically indeterminate states before measurement and hyperplane-dependent wave collapse. (shrink)

The main aim of our paper is to show that interpretative issues belonging to classical General Relativity (GR) might be preliminary to a deeper understanding of conceptual problems stemming from on-going attempts at constructing a quantum theory of gravity. Among such interpretative issues, we focus on the meaning of general covariance and the related question of the identity of points, by basing our investigation on the Hamiltonian formulation of GR. In particular, we argue that the adoption of a peculiar gauge-fixing (...) within the canonical reduction of ADM metric gravity may yield a new solution to the debate between substantivalists and relationists, by suggesting a \emph{tertium quid} between these two age-old positions. Such a third position enables us to evaluate the controversial relationship between entity realism and structural realism in a well-defined case study. After having indicated the possible developments of this approach in Quantum Gravity, we discuss the structuralist and holistic features of the class of spacetime models that are used in the above mentioned canonical reduction. The paper defends two claims; Viewed from the perspective of the substantivalism/relationism debate, structural spacetime realism is a form of relationism; However, if we managed to reinforce Rynasiewicz’s point that the general theory of relativity makes the substantivalism/relationism dispute “outdated”, the re-elaboration of Stein ’s 1967 version of structural spacetime realism to be proposed here proves to be a good, antimetaphysical solution to the problem of the ontological status of spacetime.

In this paper we argue that quantum mechanics provides a genuine kind of structural explanations of quantum phenomena. Since structural explanations only rely on the formal properties of the theory, they have the advantage of being independent of interpretative questions. As such, they can be used to claim that, even in the current absence of one agreed-upon interpretation, quantum mechanics is capable of providing satisfactory explanations of physical phenomena. While our proposal clearly cannot be taken to solve all interpretive issues (...) raised by quantum theory, we will argue that it can be successfully applied to some of its most puzzling phenomena, such Heisenberg's uncertainty relations and quantum non-locality. The discussion of these two case studies will also serve to illustrate the main properties of structural explanations and compare them to the DN and the unificationist models. Finally, we briefly discuss how structural explanations might relate to structural realism. (shrink)

My first and main claim is that physics cannot provide empirical evidence for the objectivity of absolute becoming, for the simple reason that it must presuppose it, at least to the extent that classical spacetime theories presuppose an ontology of events. However, the fact that a theory of absolute becoming must be situated in the a priori realm of metaphysics does not make becoming completely irrelevant for physics, since my second claim will consist in showing that relational becoming, once appropriately (...) defined and understood, properly belongs to the tangled set of issues usually referred to with the label “the arrow of time”. In this respect it is argued that the arrow of becoming is more fundamental both than the causal arrow and of other well-known physical processes that are temporally asymmetric. (shrink)

This paper situates Einstein’s theory of relativity within broader networks of communication.The speed of light, explained Einstein, was an unsurpassable velocity if, and only if, it was considered in terms of »arbitrary« and »voluntary« signals. Light signals in physics belong within a broader set of signs and symbols that include communication and military signals, understood by reference to Helmholtz, Saussure, media philosophies from WWII to ‘68 (Lavelle, Ong, McLuhan) and Derrida. Once light signals in physics are considered in relation to (...) semaphore, print, telegraph, radio, computers and tape recorders, Kittler and Habermas provide us with conflicting ways for understanding science and technology, rationality and consensus.We conclude with a study of »flash and bang« in popular accounts of relativity theory to understand the role of theoretical science in the transmission of information and violence. Al pasar de una figura universal y abstracta, a una concreta y real, el sistema de la simpatía permite pensar en la continuidad que hay entre (...) la comunidad moral y la comunidad política y también en su ruptura, cuando la segunda se convierte en el espacio que permite manejar la exclusión que puede generar la primera. La invisibilidad de algunos miembros de la comunidad moral exige la creación de un espacio de tolerancia para evitar la violencia simbólica que implica la negación de participar en la comunicación afectiva de la simpatía. ABSTRACT The system of sympathy introduces a change in the figure of the other with respect to the school of moral sense. The reconstruction of this change reveals an important difference between A. Smith and his Scottish Enlightenment predecessors, which allows for the examination of the role of politics in Smith's work from a new angle. By replacing an abstract, universal figure with a concrete, actual one, the system of sympathy makes it possible to think the continuity between the moral community and the political community, but also its disruption, whenever the latter becomes a space to handle the exclusion that might be generated by the former. The invisibility of some of the members of the moral community requires the creation of a space of tolerance in order to avoid the symbolic violence entailed by the refusal to participate in the affective communication of sympathy. Ao passar de uma figura universal e abstrata para uma concreta e real, o sistema da simpatia permite pensar na continuidade que há entre a comunidade moral e a comunidade política e também em sua ruptura, quando a segunda se converte no espaço que permite manejar a exclusão que pode gerar a primeira. A invisibilidade de alguns membros da comunidade moral exige a criação de um espaço de tolerância para evitar a violência simbólica que implica a negação de participar na comunicação afetiva da simpatia. Bernard Mandeville denunciou a filosofia moral de seu tempo, tanto suas dimensões teóricas quanto práticas, como elitista e contrária à natureza humana. As explicações e recomendações derivadas dessa filosofia moral, segundo Mandeville, eram inadequadas para entender e governar a sociedade comercial. Mandeville examinou as explicações existentes sobre a natureza humana, confrontou-as com o que apresentou como fatos e desvendou suas contradições.
